Greetings from the Gem & Jewellery Export Promotion Council!

With respect to the IIJS, the Council has received several written requests from its esteemed members from the trade making recommendations that it is necessary to expand the ambit of the Equitable Opportunity Clause which is currently in force in the Council inter-alia citing reasons of the long waiting list etc. Based on such letters and feedback received by the Council, the applicable period under the Equitable Opportunity Clause is proposed to be enhanced to 30 days before the start of the show and 15 days after the completion of the show. The Equitable Opportunity Clause is also proposed to be applied uniformly across all events / exhibitions organized by the Gem and Jewellery Export Promotion Council (“GJEPC”).

JUSTIFICATION: As you are aware, the space application form in respect to the IIJS organized by GJEPC, contains an Equitable Opportunity Clause, wherein inter alia the exhibitor is restrained, for a period of 1 week before the start of the show and 1 week after the completion of the show, from (directly or indirectly) applying / participating / exhibiting in any show or exhibition or fair within Mumbai or Greater Mumbai which is similar to exhibitions or shows or fairs related to gems & jewellery organized by such company which is engaged in the activities that compete with the activities of GJEPC or of any of its subsidiaries or affiliates. The said clause has been in force for the past several years and has widely been accepted by the GJEPC’s members / exhibitors as fair and reasonable.

Based on the requests and demands received from Members, GJEPC is considering expanding the ambit of the applicable restrictive period under the Equitable Opportunity Clause. Some of the reasons for enhancing the restriction are, long waiting list of applicants; equitable distribution of opportunities; maximum participation of exhibitors and buyers; maintaining uniqueness and exclusivity of designs available in a GJEPC exhibition; increase in foot falls of buyers and participants; availability of sufficient stocks / designs of exhibitors etc. GJEPC accordingly, is considering an amended version of the existing Equitable Opportunity Clause, under which inter alia the exhibitor / member is restrained, for a period of 30 days before the start of the show and 15 days after the completion of the show, from (directly or indirectly) participating / exhibiting in any show or exhibition or fair, relating to gems & jewellery, within the city limits where the IIJS is organized, which is similar in nature to IIJS. GJEPC is considering introducing the amended version of the existing Equitable Opportunity Clause to safeguard the interests of the trade, its members and the appeal of the GJEPC’s events.

The revised Equitable Opportunity Clause being proposed is reproduced as under:

“Any member/exhibitor shall not directly or indirectly participate/exhibit at any fair/show/exhibition of any form or nature, related to gems & jewellery, within the city limits where the IIJS is organized which is similar in nature to IIJS for a period of 30 days before the start and 15 days after the completion of IIJS. In case any member who is a participant/exhibitor at IIJS is found violating this clause, then disciplinary action will be initiated against such member/exhibitor, which will include immediate closure of the booth of the member/exhibitor and/or the said member/exhibitor will lose the chance to exhibit or participate at all future events of the Council and/or be blacklisted/debarred from all the future activities of Council.”

Please note that GJEPC is also considering whether or not a materially similar clause be inserted in the concerned space application forms of all other events organized by GJEPC, inter alia, basis the location and dates of respective show/fair/exhibition organized by GJEPC.

  1. THE COUNCIL SHOULD REVISE THE APPLICABILITY OF THE EQUITABLE OPPURTUNITY CLAUSE TO 30 DAYS BEFORE THE SHOW AND 15 DAYS POST COMPLETION OF SHOW. VOTE: YES/NO
  2. THE COUNCIL SHOULD INTRODUCE A SIMILAR CLAUSE IN OTHER EXHIBITIONS / EVENTS ORGANISED BY GJEPC. VOTE: YES/NO
